After the French Revolution, the codification movement led to the introduction of the Dutch Civil Code and the Commercial Code of 1838. These codifications were generally regarded as the bedrock of a dogmatic system in which little space was left for customs and customary law. Mercantile jurists, such as Holtius and Levy, were opponents of the legalistic approach of the new codifications. They tried to separate mercantile law from civil law in order to protect mercantile law from excessive legalistic influences. (...) According to them, mercantile law was characterised by internationality, custom as its main source of law, continuity through an extended mercantile legal history and by good faith and mutual trust between the merchants. Out of these, the historicity and homogeneity of a strong community of merchants are particularly in line with a traditional and conservative view on society. Holtius and Levy, however, had little in common with their Christian-conservative contemporaries. On the one hand, they rather seemed to foreshadow the kind of liberal-conservatism as expressed by Hayek during the 20th century. On the other hand, their ideas have much in common with different lex mercatoria –traditions developed by authors as Goldman and Schmitthoff. On the aspects of historicity and internationality Holtius and Levy seem to have much in common with Hayek whereas concerning communality and the legal nature of customary law there are more similarities with the lex mercatoria-traditions. We routinely need to process the identity of many faces around us, and how the brain achieves this is still the subject of much research in cognitive neuroscience. To date, insights on face identity processing have come from both healthy and clinical populations. However, in order to directly compare results across and within participant groups, and across different studies, it is crucial that a standard task is utilised which includes different exemplars (for example, non-face stimuli along with faces), is memory-neutral, (...) and taps into identity recognition across orientation and across viewpoint change. The goal of this study was to test a previously behaviourally tested, optimised face and object identity matching design in a healthy control sample whilst being scanned using fMRI. Specifically, we investigated categorical, orientation, and category-specific orientation effects while participants were focused on identity processing of simultaneously presented exemplar stimuli. Alongside observing category and orientation specific effects in a distributed set of brain regions, we also saw an interaction between stimulus category and orientation in the bilateral fusiform gyrus and bilateral middle occipital gyrus. Generally these clusters showed the pattern of a heightened response to inverted, as opposed to upright faces; and to upright, as opposed to inverted shoes. These results are discussed in relation to previous studies and to potential future research within prosopagnosic individuals. (shrink)

There are many ways to assess face perception skills. In this study, we describe a novel task battery FEAST (Facial Expression Action Stimulus Test) developed to test recognition of identity and expressions of human faces as well as stimulus control categories. The FEAST consists of a neutral and emotional face memory task, a face and object identity matching task, a face and house part-to-whole matching task, and a human and animal facial expression matching task. This study aimed to evaluate if eye blinks can be used to discriminate players with different performance in a session of Nintendo Entertainment System (NES) Tetris. To that end, we developed a state-of-the-art method for blink extraction from EAR measures, which is robust enough to be used with data collected by a low-grade webcam such as the ones widely available on laptop computers. Our results show a significant decrease in blink rate per minute (blinks/m) during the first minute of playing (...) Tetris. After having defined 3 groups of proficiency based on in-game performance (Novices, Intermediates, and Experts) we found out that expert players display a significantly lower decrease in blinks/m compared to novices during the first minute of gameplay, which shows that Tetris players' proficiency can be detected by looking at eye blinks/m variations during the early phase of a game session. This difference in blinks/m is observed throughout the entire game session, which supports the general conclusion that proficient Tetris players have a lower decrease in blinks/m, even when playing more difficult levels. Finally, we offer some interpretations of this effect and the relationship that our results may have with the visual cognitive workload experienced during the gameplay. (shrink)

Personalised learning systems—systems that predict learning needs to tailor education to the unique learning needs of individual students—are gaining rapid popularity. Praise for educational technology is often focused on how technology will benefit school systems, but there is a lack of understanding of how it will affect the student and the learning process. By uncovering what the meaning of ‘personal’ is in educational philosophy and as embodied in the technology, we illustrate that these two understandings are different regarding the autonomy (...) of the student. Personalised learning technology, therefore, bears the risk of failing to achieve its educational ideal of what personalisation should be. We also illustrate how personalised learning technology effects student autonomy by requiring the intensive tracking of the learning process, exposing them to privacy and data protection risks. We do not claim that education does not need technology, but we want to illustrate the importance of values as drivers of innovation. (shrink)

The aim of this study was to test whether an online video game can be used to investigate planning ability and whether fluid intelligence, objective numeracy, and subjective numeracy are predictive of game performance. Our results demonstrate that fluid intelligence is particularly important, which is in line with previous non-game-based studies that show a relationship between classical planning tests and fluid intelligence. Video games have been previously used for research into cognitive processes and taking them online facilitates data collection on (...) a larger scale. Online video games also afford data collection without the expense and stress of a laboratory environment. For these reasons, using online video games to investigate human cognition is a promising alternative to the classic cognitive paradigms used in laboratories. (shrink)

In The Doctrine of God Dolf te Velde examines the interaction of method and content in three historically important accounts of the doctrine of God.

This article addresses the research question: “How do Dutch highly educated Muslim women of Moroccan descent use prayer in dealing with problems?” The theoretical framework was mainly based on the work of Pargament et al. regarding religious coping. The empirical part of the study consisted of a quantitative and a qualitative part. This article presents results of the quantitative part. For the quantitative part of our research, 177 questionnaires were collected using snowball sampling. We asked respondents about their praying practices (...) and their ways of religious coping, using the Brief RCOPE. The connection and communication in their prayer with a loving, caring, benevolent God is the main religious way in which these Muslim women of Moroccan descent cope with all kinds of problems. This use of prayer as a way of coping can be clarified through the psychological functions of religiosity and prayer that are suggested by Pargament, Koenig, and Perez. Prayer could help them in: finding meaning, being master over their circumstances and controlling their emotions, finding comfort and closeness to God, experiencing intimacy with others and closeness to God, and transforming their way of life. We did find few negative religious coping strategies, such as negative feelings towards God or alienation. This is in line with research results of Abu Raiya and Pargament. As Islam implies surrender to God, it may be difficult for Muslims to admit their religious distress, doubts, and struggles. (shrink)

This paper presents the results of an empirical study among two groups of psychotherapists in the Netherlands. One group works in a mental health institution based on religious principles , and the other group in a general mental health institution . The investigation starts with an overview of the religious background and religious practices of the therapists. Some equations with the average Dutch citizen are made. The next part of the study deals with the perception by psychotherapists of religious issues (...) connected with psycho-social problems. How often in their opinion is there a relation and what kind of relation is at issue? The third part of the study considers the way in which psychotherapists treat these religious issues. Do they attend to them and what kind of interventions are used? Special attention is given to the question of whether there are contacts with the clergy. We conclude that religion should be given a more pronounced place in general mental health care and that Riagg psychotherapists, in particular, should become better equipped to deal with religious issues. Introduction While quizzing during informed consent for research to ensure understanding has become commonplace, it is unclear whether the quizzing itself is problematic for potential participants. In this study, we address this issue in a multinational HIV prevention research trial enrolling injection drug users in China and Thailand. Methods Enrolment procedures included an informed consent comprehension quiz. An informed consent survey followed. Results 525 participants completed the informed consent survey (Heng County, China=255, Xinjiang, China=229, Chiang Mai, Thailand=41). Mean age was (...) 33 and mean educational level was 8 yrs. While quizzing was felt to be a good way to determine if a person understands the nature of clinical trial participation (97%) and participants did not generally find the quiz to be problematic, minorities of respondents felt pressured (6%); anxious (5%); bored (5%); minded (5%); and did not find the questions easy (13%). In multivariate analysis, lower educational level was associated with not minding the quizzing (6–10 yrs vs 0–5 yrs: OR=0.27, p=0.03; more than 11 yrs vs 0–5 yrs: OR=0.18, p=0.03). There were also site differences (Heng County vs Xinjiang) in feeling anxious (OR=0.07; p=<0.01), not minding (OR=0.26; p=0.03), being bored (OR=0.25; p=0.01) and not finding the questions easy (OR=0.10; p=<0.01). Conclusions Quizzing during the informed consent process can be problematic for a minority of participants. These problems may be associated with the setting in which research takes place and educational level. Further research is needed to develop, test and implement alternative methods of ensuring comprehension of informed consent. Trial Registration clinicaltrials.gov number NCT00270257. (shrink)

This article presents the results of a study in The Netherlands among two groups of religious people: i.e., 165 Christian outpatients and 171 parishioners. In this study, we focused on the following main questions. To what degree did these two groups of Christians practice positive religious coping, negative religious coping and receptive coping? What are the relationships between these three coping strategies? To what degree were positive religious, negative religious and receptive coping activities related to the well-being of the respondents? (...) What are the best predictors of well-being: positive religious, negative religious or receptive coping? The results showed that positive religious, negative religious and receptive coping were three independent predictors of well-being, with negative religious coping being the best predictor. (shrink)

Artificial intelligence (AI) systems are increasingly being used not only to classify and analyze but also to generate images and text. As recent work on the content produced by text and image Generative AIs has shown (e.g., Cheong et al., 2024, Acerbi & Stubbersfield, 2023), there is a risk that harms of representation and bias, already documented in prior AI and natural language processing (NLP) algorithms may also be present in generative models. These harms relate to protected categories such as (...) gender, race, age, and religion. There are several kinds of harms of representation to consider in this context, including stereotyping, lack of recognition, denigration, under-representation, and many others (Crawford in Soundings 41:45–55, 2009; in: Barocas et al., SIGCIS Conference, 2017). Whereas the bulk of researchers’ attention thus far has been given to stereotyping and denigration, in this study we examine ‘exnomination’, as conceived by Roland Barthes (1972), of religious groups. Our case study is DALL-E, a tool that generates images from natural language prompts. Using DALL-E mini, we generate images from generic prompts such as “religious person.” We then examine whether the generated images are recognizably members of a nominated group. Thus, we assess whether the generated images normalize some religions while neglecting others. We hypothesize that Christianity will be recognizably represented more frequently than other religious groups. Our results partially support this hypothesis but introduce further complexities, which we then explore. (shrink)

Nigeria is indeed a typical pluralistic society with innumerable differences in culture, ethnicity, tribe, religion, and class. Yet there exists in Nigeria certain dominant cultures, ethnic nationalities, religions, and classes. In some parts of the country the influence of a dominant culture or ethnic group is more pronounced than in others. This paper is therefore an attempt to look into our pluralism and see how it can enhance the development and promotion of democracy in the country. This study investigated the relationships among oppositional defiant attitudes, moral reasoning, moral value evaluation and self-reported delinquent behaviour in adolescents (N = 351, MAGE = 13.8 years, SDAGE = 1.1). Of particular interest were the moderating effects of age, educational environment and gender on the relationship between moral reasoning and delinquency. The results indicate that oppositional defiance was a strong positive correlate of delinquent behaviour, particularly in late adolescence. Furthermore, moral reasoning was modestly and negatively related to delinquency, but only (...) for males. No moderating effects for educational environment were observed. Moreover, moral value evaluation was uncorrelated with delinquent behaviour when controlling for other sociomoral processes. These findings invite further research on the relationship between attitudes and behaviour, with respect to causal links and practical applications within behavioural interventions. (shrink)

As the use of algorithmic decision‐making becomes more commonplace, so too does the worry that these algorithms are often inscrutable and our use of them is a threat to our agency. Since we do not understand why an inscrutable process recommends one option over another, we lose our ability to judge whether the guidance is appropriate and are vulnerable to being led astray. In response, I claim that a process being inscrutable does not automatically make its guidance inappropriate. This phenomenon (...) is not restricted to algorithms, and there are many social processes which we should conform to but are similarly unable to judge for ourselves. I provide a framework for how we can depend on inscrutable processes by introducing a distinction between knowing conformity (where I understand what justifies the guidance) from mere conformity (where I merely do what I am told) and showing how mere conformity is often positively valuable because it allows for extended processes that in turn allow us to accomplish more than we could on our own. This is in effect a division of deliberative labour, which I argue is something commonplace but not often recognised, of which algorithmic guidance can be an example. (shrink)

n this thesis I describe how conventions specify how to put normative principles into practice. I identify a class of recurring situations where there are some given normative principles in effect, but they underdetermine what each individual should do, and what is best for an individual depends on what others do. I demonstrate that in such cases, whenever the community develops a response that repeatedly brings them to as good an outcome as is available according to their principles, that response (...) is a Lewisian convention where the benefit of an outcome to each individual is measured by the extent to which it conforms to the principles they subscribe to. Since these conventions are constrained by the normative principles, I call them limited conventions. They are supplements to the principles, and are ineradicably involved in moral action insofar as the abovementioned cases of moral underdetermination are in play. That has the consequence that in these cases the only reliable way to follow your principles is to follow the relevant conventions. As examples of this mechanism I offer a conventionalist analysis of authority, such that the commands of an authority is normative when they instantiate a limited convention, and of the variation in understandings of virtue and vice across societies, such that the evaluative vocabulary of each society is a set of different limited conventions about how to express in word and deed the evaluative points of the virtues and vices in question. Finally, I discuss how conventions and similar forms of guidance provide a way for individuals to participate in their community’s moral life without having a full understanding of the principles that underlie it, or even if they are profoundly ignorant or outright mistaken about the demands of morality. There is not as much resistance to COVID-19 mitigation as there seems, but there are structural features that make resistance seem worse than it is. Here we describe two ways that the problem seeming to be worse than it is can make it worse. First, visible hesitation to implement COVID-19 responses signals to the wider society that mitigation measures may not succeed, which undermines people’s conditional willingness to join in on those efforts. Second, our evaluations of others’ willingness to implement (...) these measures are informed by our attempts to mind-read them. Yet attempts to mind-read groups often mislead us, because groups invariably act from diverse motives whereas mind-reading works best when identifying relatively stable and consistent motivations. This means that a small minority of people refusing to implement measures can have an outsized prominence that prompts mind-reading to diagnose widespread hesitation. These two factors form a feedback loop with each other: we see some people’s hesitation, which prompts us to mind-read other people as being more uncertain about the responses than they actually are, which undermines our confidence in the responses, which in turn encourages others to mind-read this hesitation, which further undermines confidence. In the past two decades, public sociologists have sought to revive what C. Wright Mills called a 'democratic society of publics'. The publics that such sociologists promote are intellectual ones that resemble Socratic dialogues in which people search for the good order. Nietzsche criticizes such publics for their plebeian character and introduces an alternative type of publics: aesthetic publics. Rather than Socratic dialogues, the art of tragedy is the model of such publics. In this article it is argued that the (...) art of tragedy sheds a different light on the concept of publics and can only enrich the sociological discipline. (shrink)

Nietzsche's ethics is basically an ethics of virtue. In his own unique way, and in accordance with his extra-moral view of life, Nietzsche recovers and re-appropriates certain virtues – notably pagan, aristocratic virtues – as part of his project to reconceptualise (‘rehabilitate') the virtues in terms of virtù (virtuosity and vitality), to which he also refers as his ‘moraline-free' conception of the virtues. The virtue of generosity (in the sense of magnanimity) plays a central role in Nietzschean ethics. According to (...) Nietzsche, the truly noble or virtuous person is one who lives beyond resentment and feelings of remorse and guilt. He lives his life from the fullness and plenitude of his own being and what he is able to bestow on others. Nietzsche seeks to rekindle and rehabilitate the aristocratic ‘pathos of distance' as the true origin of ethical life. This pathos of distance basically emanates from self-respect: ‘The noble soul has reverence for itself' (1974b: §287). For Nietzsche, this means that one should realize the greatest multiplicity of drives and form-giving forces in oneself, in the most tension-fraught but ‘controlled' manner. This control, this imposing a form on oneself without neglecting the multiplicity in oneself, is a creative, artistic activity. Nietzsche also refers to this as a process of transforming the self into a work of art, of giving style to one's own existence. Thus we free ourselves from guilt, resentment and the rage against contingency. It is of the utmost importance for Nietzsche that one should attain satisfaction with oneself, for ‘only then is a human being at all tolerable to behold. Whoever is dissatisfied with himself is continually ready for revenge, and we others will be his victims, if only by having to endure his ugly sight.' (1974a: §290). To attain satisfaction with oneself ultimately means to affirm life in its totality. This implies a life beyond resentment, i.e. a life that is characterised by generosity or magnanimity ( megalopsychia, magnanimitas ), which is for Nietzsche the ‘crown' of all the virtues. Tenslotte stel ik de vraag of, afgezien van Aristoteles, er reden is om te denken dat de metafoor een ‘cognitief extra’ heeft boven een mededeling in normale bewoordingen, en speciaal de wat soms genoemd wordt ‘levende’ metafoor. The aim of this paper is to investigate the transition in natural science from the search for the essence of matter to the search for the laws to which matter is subject. Starting about 1600, this transition meant a change of perspective, the introduction of a new metaphysical view of the world. A scientific worldview has at least four components, its ontology, epistemology, logic and heuristic, which I shall discuss with respect to the idea of natural law.

The aim of this article is to provide a discussion of scholarly ‘crisis of modernity’ discourses that have developed in the field of social philosophy. Re-visiting past and present discourses can be illuminating in at least three ways: it can reveal the broader picture of the present financialized and technologized world and the rise of financial technologies; it can provide scholars with new vocabularies, concepts, and metaphors to comprehend present-day phenomena and developments; and it can reveal the variety of commitments (...) that are possible, today, too. This article starts with a discussion of the original ‘crisis of modernity’ discourses, in which the clashing arguments of Comte and Tocqueville are featured, and a discussion of a second ‘crisis of modernity’ that developed in the context of the ‘Great Depression.’ A third ‘crisis of modernity’ discourse emerged in the wake of the financial crises of the 1970s. Such crises are still ongoing and discussed within the boundaries of the third ‘crisis of modernity’ discourse. How financial technologies do and do not fit within this third discourse is discussed in the remainder of this article. (shrink)

Traditional eliminativism is the view that a term should be eliminated from everyday speech due to failures of reference. Following Edouard Machery, we may distinguish this traditional eliminativism about a kind and its term from a scientific eliminativism according to which a term should be eliminated from scientific discourse due to a lack of referential utility. The distinction matters if any terms are rightly retained for daily life despite being rightly eliminated from scientific inquiry. In this article, I argue that (...) while scientific eliminativism for pain may be plausible, traditional eliminativism for pain is not. I discuss the pain eliminativisms offered by Daniel Dennett and Valerie Hardcastle and argue that both theorists, at best, provide support for scientific eliminativism for pain, but leave the folk-psychological notion of pain unscathed. One might, however, think that scientific eliminativism itself entails traditional eliminativism—for pain and any other kind and corresponding term. I argue that this is not the case. Scientific eliminativism for pain does not entail traditional eliminativism about anything. (shrink)

The role of faith and religion in international development cooperation is hotly debated today. The legitimacy of this role remains, however, often confided to instrumental reasons. Yet, thinking about faith and religion only in instrumental terms leaves unquestioned the possibility of a religious background of development cooperation as a practice itself and the potential role of faith through individual practitioners that operate within secular NGOs, and research and policy institutes. The aim of the present paper is therefore to consider the (...) structural role of faith and worldview in relation to agricultural development, moving beyond the discourse of instrumentality. We do this by focusing on Giller and Andersson’s political agronomy analysis of the promotion of Conservation Agriculture in Zimbabwe by the faith-based organisation ‘Foundations for Farming’. We argue that a distinction should be made between religion as a practice of believers and faith functioning as a worldview in every practice. In addition, we argue that it is helpful to distinguish between different kinds of practices involved in agricultural development in sub-Saharan Africa, namely farming practice, agronomic scientific practice, and faith practice. The value of this philosophical analysis is that it challenges a dichotomous model of ‘science-based versus faith-based’ approaches to agricultural development. Furthermore, specific kinds of normativity are identified as always already functioning inside practices, rather than practices being neutral spaces that are infused with normativity by applying external ethical standards.
